Information on the procedure

Everyone has the right to request that a digital website, mobile application or some element thereof be made accessible. It is also possible to request that the information be made available by means of an alternative means of access, for example by reading out loud to them a digitally inaccessible document, describing the content of a film without an audio description, etc. The request should include the details of the person making it, an indication of which website or mobile application is considered and the means of contact. If the requester indicates a need to receive the information by alternative means of access, they should also specify how the information is to be presented in a way that is convenient for them. The public body should comply with the request without delay and no later than 7 days from the date it was made. If it is not possible to meet this deadline, the public body shall inform the requester without delay when the request can be complied. The new deadline shall not be longer than 2 months from the date of making the request. If providing digital accessibility is not possible, the public body may propose an alternative means of accessing the information. As regards the redress procedure, we point out that if a public body refuses to comply with a request to provide accessibility or an alternative means of accessing information, the requester may file a complaint regarding the provision of accessibility of a digital website, a mobile application or an element of a website or mobile application. Once the procedure indicated above has been exhausted, an application may be made to the Ombudsman: www.rpo.gov.pl.
